Euphoria Independent Health Visiting Services Terms And Conditions
Introduction
These Terms will become binding on You (defined below) and Us, and the “Agreement” will come into existence when You explicitly request that I begin to supply the Services to You, or I begin to provide the Services to You. Please read them carefully. If You disagree with any part of these Terms, then please talk to Me before booking My Services.
1. Interpretation and Definitions
1.1 The words in which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.
“Company” (referred to as either “the Company”, “Me”, or “My” in this Agreement) refers to www.eihv.co.uk.
“Elite Bundle” means the collection of services as described on My Website and in My leaflet.
“Premium Bundle” means the collection of services as described on My Website and in My leaflet.
“Starter Bundle” means the collection of services as described on My Website and in My leaflet.
“Terms and Conditions” (also referred as “Terms”) mean these Terms and Conditions that form the
the entire agreement between You and the Company regarding the use of the Service.
“Website” refers to Euphoria Independent Health Visiting, accessible from www.eihv.co.uk
“You” means the individual accessing or using the Service, or the company, or other legal entity on
behalf of which such individual is accessing or using the Service, as applicable.
“Services” means the Health Visiting Services set out on My Website and which are either provided by Katherine Offer.
“Feedback” means feedback, innovations or suggestions sent by You regarding the attributes,
performance or features of My Services.
2. My Commitments to You
2.1 I agree that I shall provide You with the most up-to-date, relevant, evidence-based information in the provision of My Services.
2.2 I commit to abiding by the Nursing & Midwifery Council Code of Conduct and adhering to their requirements for registration which includes a minimum number of hours of study and practice each year.
3. Your commitments to Me
3.1 It is Your responsibility to share the medical history of You and Your family. Should I advise You to seek medical advice for Yourself or Your family, it is Your responsibility to do so, and I will not accept any responsibility for failure on Your part to do so.
3.2 You agree to provide a safe and clean home environment, free from hazards, and appropriate for the Services and further, to inform Me if You are unwell on the day of the visit, especially if Your illness is infectious.
3.3 You agree to follow My reasonable advice and instructions to get the maximum benefit of the Services.
4. Data Protection
4.1 I will collect and process certain personal information from You as part of the provision of the Services. Please see My Privacy Policy for more information.
5. Fees and Payments
5.1 The fees for My Services are set out on My Website.
5.2 You must pay for My Services as follows:
5.2.1 For the Elite Bundle there are Two payment options: Pay in Full on booking or in Three Payments of 34% on booking; 33% on the birth of Your baby; 33% at six weeks postnatal.
5.2.2 For the Premium Bundle there are Two payment options: Pay in Full on booking or in Two Payments of 50% on booking; 50% on the birth of Your baby.
5.2.3 For the Starter Bundle the fees must be Paid in Full on booking.
5.3 You must make all payments by direct bank transfer to the account provided via e-mail.
6. Refunds and Cancellations
6.1 You have the right to cancel the Agreement immediately, within the first 14 days without giving any reason. The cancellation period ends at the end of 14 days after the day on which You book the Services.
6.2 To exercise that right to cancel, You must inform Me of Your decision to cancel the Agreement by a clear statement, such as a letter sent by post or email. I will acknowledge Your request within 2 working days. If I do not, I may not have received your request to cancel (although the date You send Your request will still be the date of service of Your notice to cancel under this clause), so please contact Me directly to tell Me You sent an email or sent Me a letter. I may require proof of sending/contact so please keep something to show Meas proof of cancellation in case You are asked.
6. 3 If You have received some Services, then I will retain some of the fees (if You have already paid them) representing the value in the Services You already received at the rate of the Starter Bundle. I will also deduct an administration fee of £200. I will refund You the remaining amount.
6.4 In all circumstances, I will provide You with a final invoice detailing any refund that is due to You or, if no refund is due to You, the costs which might remain payable.
6.5 Iwill refund You the balance of what is due to You no later than 14 days after the day on which I am informed about Your decision to cancel the Agreement. I will make the reimbursement using the same payment method as You used to pay Me, unless You have expressly agreed with Me that I can reimburse You using a different payment method. In any event, You will not incur any fees as a result of the reimbursement.
6.6 Cancelling after the first 14 days: If You wish to cancel the Agreement after the first 14 days, You must provide Me with at least 14 days’ notice in writing. You must continue to pay for the Services which were due to be delivered during Your 14-day notice period (calculated in accordance with Your chosen Bundle). I will refund You any payments made in advance for Services due to being delivered after the end of Your 14-day notice period.
6.7 You may cancel the Agreement with immediate effect by giving us written notice if:
6.7. 1 Ibreach the Agreement in any material way, and I do not correct or fix the situation within 14 days of You asking me to in writing;
6.7.2 I go into liquidation or a receiver or an administrator is appointed over Our assets;
6.7.3 I attempt to change these Terms without giving You at least one-month notice; or
6.7.4 I are unable to provide the Services because of an event outside our reasonable control.
6.8 I may cancel the Agreement at any time with immediate effect by giving You written notice if:
6.8.1 You pose a risk to Me or You fail to pay any amounts due to Me;
6.8.2 You abuse Me physically or verbally; or
6.8.3 You materially breach the Agreement in any way.
6.10 I may cancel the Agreement at any time by serving You with no less than 30 days written notice.
7. Complaints
7.1 If You have any issues or complaints regarding My services, please contact Me directly or by emailing connect@eihv.co.uk
8. Limitation of Liability and Disclaimer
8.1 I will compensate You for loss or damage You may suffer if I fail to carry out duties imposed on Me on law, but not where that failure is attributable to:
8.1.1 Your fault;
8.1.2 third party unconnected with the provision of Services under this Agreement;
8.1.3 any deliberate act or omission by Me; or
8.1.4 an event which I would not have foreseen or prevented even if I had taken all reasonable care.
8.2 I accept no liability for any losses, costs, damages, claims, or expenses in relation to Your personal property, including Your home or Your vehicle.
8.3 I do not exclude, or limit in any way, My liability for (a) death or personal injury caused by My negligence or the negligence of My employees, agents or subcontractors; (b) fraud or fraudulent
misrepresentation: or (c) any other liability which cannot be limited or excluded by law.
8.4 To the maximum extent permitted by applicable law, in no event shall I be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of data or other information, for personal injury, loss of privacy arising out of or in any way related to the use of or inability to use the Services, or otherwise in connection with any provision of this Terms).
Disclaimer: I will ensure to use My best professional judgement taking into account Mytraining and knowledge as registered Paediatric Nurses and Specialist Community Public Health Nurse professionals when providing the Services. In particular, I will ensure that My advice accords that the standards set by the Nursing & Midwifery Council Code of Conduct. You understand and accept that I am not and do not purport to be medical doctors. If You have a concern about Your health or the health of Your baby or unborn baby, You think You may be suffering from a medical condition, You should seek immediate medical attention. You should never delay seeking medical advice, disregard medical advice or discontinue medical treatment because of Your use of My Services.
You further accept that I am not a legal or financial expert, and You should contact the relevant professional if You have any such questions or issues.
9. Changes to the Terms
9.1 I reserve the right, in My sole discretion, to modify or replace these Terms at any time. If I make any big changes to the Terms, I will send You a copy but please do check M Website regularly for updates. By continuing to access or use My Services, after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please tell Me and I will need to discuss whether Ican continue with My Services.
10. Health and Safety and Safeguarding
10.1 I need to ensure that You and are safe when providing You with the Services, therefore I will undertake a risk assessment before beginning the Services. If I consider there to be a health and safety risk, I will advise and discuss this with You to try and find a solution. If I amunable to find a solution, I will not be able to provide or continue with the Services (if a health and safety issue occurs after I start providing the Services).
10.2 Your safety and the safety of Your child are My priority. I will ensure to follow the minimum government guidance in place from time to time regarding appropriate COVID-19 measures. In addition, I will wear PPE during visits unless otherwise agreed. I will also test regularly for COVID-19 but You accept, however, that the use of these measures may not prevent the transmission of COVID-19.
10.3 If I have any safeguarding concerns at any point, I am under obligation to report them to Devon County Multi-Agency Safeguarding Hub. If a safeguarding issue occurs, I am not obliged to inform You before the relevant authorities, if I feel Your child is at risk by doing so or if I feel I am at risk by doing so.
11. Governing Law and Jurisdiction
11.1 These Terms and the Agreement (including any non-contractual matters) are governed by the law of England and Wales and You agree that the courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of these Terms or the Agreement.
